What is a Trademark Objection?

After your trademark application is filed, the Trademark Examiner may issue an objection if:

  • The name is too generic or descriptive
  • It resembles an existing trademark
  • It lacks distinctiveness
  • Incomplete or incorrect documentation

These objections are listed in the Examination Report under Section 9 or 11 of the Trade Marks Act, 1999.

What is a Trademark Hearing?

If your objection reply isn’t sufficient or the case is complex, the Registry may schedule a Trademark Hearing. This is a formal opportunity to present your case in front of the Registrar or Hearing Officer.

A hearing is often your final chance to defend your mark before it’s rejected.
